AMBASSADHER PRIVACY POLICY

7476, Inc. doing business as AmbassadHer ("AmbassadHer," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect through ambassadher.co and our related applications and services (collectively, the "Platform"), how we use and share it, and the choices and rights available to you. Capitalized terms not defined here have the meaning given in our Terms of Service.

BY USING THE PLATFORM, YOU AGREE TO THE PRACTICES DESCRIBED IN THIS POLICY. IF YOU DO NOT AGREE, PLEASE DO NOT USE THE PLATFORM.

1. Information We Collect

1.1 Information You Provide

  • Account and profile information. Name, email address, password, location (including ZIP code), profile photo, bio, and the niches you select (up to three) when you register or update your Creator Profile.
  • Social media information. When you connect a Social Media Provider account (e.g., Instagram, TikTok), we receive basic profile information from that provider, such as your handle, follower count, and public profile data, as authorized by you and that provider.
  • Application and submission information. Responses to Campaign application questions, draft and final Content you submit, links to published posts, purchase confirmations, and related communications.
  • Payment information. Information necessary to pay Creator compensation (such as bank or payment-processor account details) or to bill Brands. Card and bank account numbers are processed by our third-party payment processor(s) and are not stored on our own servers in full.
  • Communications. Messages you send us, including support requests, and the content of those messages.
  • Brand account information. If you register as a Brand, your company name, business contact information, and Campaign details.

1.2 Information Collected Automatically

We use privacy-focused, cookieless analytics (currently Plausible Analytics) to understand aggregate usage of the Platform, such as page views, referral sources, and general visit statistics. This analytics approach does not use cookies or persistent identifiers to track you across sessions or devices, and does not collect personally identifiable information as part of standard analytics collection. We may also collect standard server-log information (such as IP address, browser type, and access times) for security and operational purposes.

If this changes -- for example, if we adopt cookie-based analytics or advertising tools in the future -- we will update this Policy and provide any additional notice or consent mechanism required by applicable law before doing so.

1.3 Information From Other Sources

If AmbassadHer and its affiliated platform, Illuminait, share creator directory information as part of operating a shared talent network (for example, name, email, location, tags, and the platform of origin), information about you that originated on Illuminait may be reflected in our records, and vice versa, as described in Section 4.

2. How We Use Information

We use the information described above to: operate and improve the Platform; create and manage your account; match Creators to relevant Campaigns and evaluate applications; facilitate and process payments; communicate with you about your account, Opportunities, and Platform updates; enforce our Terms of Service and these policies; detect and prevent fraud or abuse; and comply with legal obligations.

3. Legal Bases for Processing (EEA/UK Residents)

If you are located in the European Economic Area or United Kingdom, we process your personal data on the following legal bases: performance of a contract with you (e.g., to operate your account and facilitate Opportunities); our legitimate interests (e.g., improving and securing the Platform, preventing fraud); your consent, where required (e.g., certain marketing communications); and compliance with legal obligations.

4. How We Share Information

We do not sell your personal information for money.

We share information as follows:

  • With Brands, for the purpose of evaluating and administering your Campaign application and participation -- limited to the information reasonably necessary for that purpose (such as your name, Social Media Provider handle, application responses, and Content).
  • With our shared talent network (Illuminait). AmbassadHer and Illuminait, an affiliated platform, synchronize a limited set of talent-directory information -- name, email, location, tags, and platform of origin -- to maintain a shared, de-duplicated creator directory across both platforms. Information originating on one platform is marked with its origin and is not altered by the other platform. If you do not want your information shared between AmbassadHer and Illuminait, contact us at support@ambassadher.co.
  • With service providers, such as payment processors, hosting providers, email delivery services, and analytics providers, who process information on our behalf and are contractually restricted from using it for their own purposes.
  • For legal reasons, to comply with law, respond to legal process, or protect the rights, property, or safety of AmbassadHer, our users, or others.
  • In a business transaction, such as a merger, acquisition, or sale of assets, in which personal information may be transferred as part of that transaction.
  • With your consent, or as otherwise disclosed to you at the time of collection.

5. Data Retention

We retain personal information for as long as necessary to provide the Platform, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary by data type; for example, application and payment records may be retained longer than general profile information to satisfy tax and accounting requirements.

6. Your Choices and Rights

6.1 Account Information

You can review and update most of your account and profile information by logging into the Platform.

6.2 Communications

You may opt out of promotional emails using the unsubscribe link in those emails or by contacting support@ambassadher.co. You may not be able to opt out of transactional or account-related messages necessary to operate the Platform.

6.3 California Residents (CCPA/CPRA)

If you are a California resident, you have the right to: know the categories and specific pieces of personal information we have collected about you; know the categories of sources, purposes, and third parties with whom we share it; request deletion of personal information we hold about you, subject to certain exceptions; correct inaccurate personal information; and not be discriminated against for exercising these rights. We do not sell personal information as defined by the CCPA, and we do not share personal information for cross-context behavioral advertising. To exercise these rights, contact us at support@ambassadher.co. We will verify your request using information associated with your account before responding.

6.4 European and UK Residents (GDPR)

If you are located in the EEA or UK, you have the right to access, correct, delete, restrict or object to processing of, and port your personal data, and to withdraw consent where processing is based on consent. To exercise these rights, contact support@ambassadher.co. You also have the right to lodge a complaint with your local data protection authority.

6.5 Other U.S. State Privacy Rights

Residents of certain other U.S. states with comprehensive privacy laws (for example, Virginia, Colorado, Connecticut, and others as they take effect) may have similar rights to access, correct, delete, and port personal information, and to opt out of certain processing. Contact us at support@ambassadher.co to exercise these rights, and we will respond consistent with the law of your state of residence.

7. International Data Transfers

AmbassadHer is based in the United States, and information we collect is processed and stored in the United States. If you access the Platform from outside the United States, your information will be transferred to, and processed in, the United States, which may not have the same data protection laws as your home jurisdiction. Where required, we rely on appropriate safeguards (such as standard contractual clauses) for such transfers.

8. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Children's Privacy

The Platform is not directed to, and we do not knowingly collect personal information from, anyone under 18. If we learn we have collected information from someone under 18, we will delete it. If you believe a minor has provided us information, contact support@ambassadher.co.

10. Changes to This Policy

We may update this Policy from time to time. Material changes will be indicated by a new "Last Updated" date and, where required, additional notice such as email. Your continued use of the Platform after a change takes effect constitutes acceptance.
